According to Mr. Son, these mini-apartments all apply for permits to build separate houses, then separate rooms for rent. In 2021, Tan Binh district discovered two cases of expansion encroaching on thousands of square meters, in which one case of a mini-apartment compressed up to 100 rooms, one case compressed up to 230 rooms.
According to a representative of the People’s Committee of Tan Binh District: The Department of Construction has issued instructions on building motel rooms. Although the district has instructions, so far, there has been no case of strictly following the instructions of the Department of Construction. Therefore, the district thinks that it is necessary to have recommendations and guidance on what the hostel regulations are like, and there should be architectural regulations regulating what types of inns are.
“How many people live in these ‘apartments’, each room has 3-4 people. There are mini-apartments without a management board, the fire protection system is not guaranteed. We need regulations to manage and handle these existing mini-apartments. These works are like a slow-exploding bomb, very worrisome,” added Mr. Son.
Need a way to manage a mini apartment
“From a legal perspective, regarding condominiums or individual houses, there are Clause 2, Article 6 of Decree 99/2015 and Clause 2, Article 46 of the Law on Housing 2014” – legal expert Nguyen Tan Dat, Director Consulting Company NTD LAW Vietnam, said.
Specifically, for individual houses built with two floors or more and at each floor designed and built with two or more apartments in a self-contained fashion (with separate living room, separate kitchen area, toilet, private bathroom), with a minimum floor area of each apartment from 30 m2 above. If this house meets the conditions for an apartment building specified in Clause 2, Article 46 of the Law on Housing, it will be granted a certificate by the State for each apartment in that house,” said lawyer Dat.
According to lawyer Dat, Clause 2, Article 46 of the Law on Housing 2014 notes: Households and individuals in urban areas must build and renovate houses according to the provisions of the law on construction and are self-sustaining. responsible for housing quality.

“But in fact, very few mini-apartments meet the above criteria but still spring up because there are many management problems. In the immediate future, local authorities need to review and have an intervention plan to prevent unsatisfactory mini-apartment projects or to legalize eligible apartments. Dat said.
Mr. Dat also said that it is necessary to plan separate areas for mini-apartments and low-cost houses, because the demand of people is increasing but the demand is not unreasonable.
