In addition, the Hoai Duc District Compensation and Site Clearance Council does not issue a notice of land recovery to each household or individual. Accordingly, 104 documents examined were missing the notice of land acquisition. In addition, Hoai Duc District People’s Committee shall make compensation and support for site clearance according to the area recorded on the land use right documents, not based on the actual measured area.
Also according to the Government Inspector, the land area of the Kim Chung – Di Trach urban area project handed over was 136.48 ha, down 1.68 ha compared to the allocated land area in Decision 1174/2008 of the People’s Committee. Ha Tay province (old). However, the project investor, the Corporation for Trade and Construction (Vietracimex) and the People’s Committee of Hoai Duc district, have not actively completed the dossier to submit to the Hanoi People’s Committee to adjust the land area allocated to Vietracimex. “The main responsibility belongs to Vietracimex, Hoai Duc District People’s Committee and relevant departments and individuals” – the notice clearly stated.
The Government Inspector also stated that the Ha Tay Provincial People’s Committee (former) recovered hundreds of hectares of land and assigned it to Vietracimex to implement the project, but did not specify the area of land allocated with land use levy, land lease, and duration. land use… as a basis for determining land use levy, not based on the approved detailed construction planning of 1/500 scale, is not complying with regulations.
Before making the decision to allocate land to Vietracimex, the Department of Natural Resources and Environment of Ha Tay province (former) did not appraise the project’s land use needs. The investor transfers real estate when the conditions are not met
Also according to the Government Inspector, the project investor had a number of other violations when implementing the above project. Accordingly, Vietracimex invests in construction of technical infrastructure works, construction works and houses of the project without keeping records, drawings, detailed construction planning maps of 1/2000 scale. , 1/500 approved by competent state agencies. Vietracimex also signed contracts to transfer land and houses for 16 customers when the project was not eligible for transfer.
With the violations at the project, the Government Inspector asked the Hanoi People’s Committee to direct the Hoai Duc District People’s Committee to urgently complete the site clearance work. Then hand over to Vietracimex to implement the project according to the overall adjustment of the approved 1/500 detailed planning, avoiding wasting land.
The Government Inspector also suggested that Hanoi City coordinate with Vietracimex to review and determine the amount of VND 20,362 billion that Vietracimex has paid, support moving graves to implement the project; make plans for compensation, support and ground clearance according to regulations. The Government Inspector also requested the Hanoi People’s Committee to direct a serious review and clearly define responsibilities as prescribed for collectives and individuals related to violations and problems in the project specified by KLTT. .
At the same time, the city directed the Hoai Duc District People’s Committee to urgently complete the site clearance and hand over to Vietracimex to implement the above project according to the overall adjustment of the approved detailed planning 1/500 scale, avoiding causing harm waste land.
