“KINGDON’T COMPLETE MISSIONS” AFTER NEGATIVE DENUNCIATION
According to the reflection of Ms. Tran Thi Thuy An (47 years old, living in Ward 7, Ben Tre City, Ben Tre), from September 2022, she was unilaterally notified by the Board of Directors (BGH) of Thanh Tan Primary School (TH) Thanh Tan. Termination of labor contracts for public employees. However, she has not received a decision since then. Therefore, on June 28, 2023, on the occasion of the reception of Mr. Le Duc Tho, Secretary of the Ben Tre Provincial Party Committee, she came to reflect on this issue.

Ms. Tran Thi Thuy An is upset because she was forced to quit her job for nearly a year but has not received a decision yet
The reason why Ms. An was forced to resign was that the Board of Directors of Thanh Tan High School assessed her as “not fulfilling her duties” in the two school years 2020-2021 and 2021-2022. Most of these two school years were due to the complicated developments of the Covid-19 epidemic, so schools mainly taught online. During that period, Ms. An repeatedly filed a complaint to her superiors about the violation of the professional regulations by the Board of Education, specifically opening an internal website to raise a false score to assess and classify students. After that, the Department of Education and Training of Mo Cay Bac concluded that this action of the Board of Directors of Thanh Tan High School was incorrect and asked to correct the assessment.
At the same time, Ms. An reflected to her superiors the phenomenon of 100 students not participating in online learning (no comment in the middle of the first term, school year 2021-2022) but still being considered good at the end of the year. At the same time, she has repeatedly sent an application to the Chairman of the People’s Committee of Ben Tre province to reflect on the quality of education at the school, on the teacher status of some teachers…
On February 15, 2022, while Ms. An was teaching in class, a number of parents and students flooded the classroom, causing a commotion, using insults and insults to her, and took their phones back. Ms. An then filed a report to the Thanh Tan Commune Police about the incident. However, until now, how she solved it is not known.
“In the 2022-2023 school year, I only came to school to find out that I was no longer assigned to teach. On September 14, 2022, the Board of Directors announced unilaterally terminating my labor contract because I was assessed incompletely for 2 consecutive years. During the year-end evaluation, I do not receive an employee quality assessment to exercise the right to complain. After each year, I ask for this evaluation form but the Board of Directors only handing over things like I’m owed union money, over-leveling… Now even the unilateral termination of the labor contract does not give me a decision. I’m really sad,” Ms. An said.
OLDÓ UNIVERSITY DEVELOPMENT, BUT RECEIVE INTERMEDIATE SALARY
According to Ms. An, since 2000 she started teaching fine arts at a private school in Ward 6, Ben Tre City. In 2012, she was recruited by Thanh Tan Primary School, so she accepted that she had to go back more than 20 km every day to be taught at a public school.
At the end of 2012, Ms. An graduated from the University of Pedagogy majoring in fine arts, then brought her diploma back to Thanh Tan High School. However, not only she still has to receive a salary according to the official regime with a vocational intermediate degree up to now, but her previous teaching seniority at private schools has not been counted in seniority by the Board of Directors of Thanh Tan Primary School to receive appropriate allowances. .
An said that she is currently single, taking care of her 76-year-old mother and 9-year-old daughter. Because she did not receive the decision to unilaterally terminate the labor contract and the employee file, she was not eligible to apply for a job elsewhere, nor did she apply for unemployment insurance benefits. More importantly, she cannot appeal or sue the decision to unilaterally terminate her employment contract.
Talking to PV Thanh Nien, on July 6, Ms. Nguyen Thi Ngoc Gam, Principal of Thanh Tan TH School, said that she has been working since February 2023 and in the official file at the school, there is no name of Ms. Tran Thi Thuy An, but Ms. Through her work, she also understood the case related to Ms. An. However, when the reporter asked again, Ms. Gam said: “The school contacted Ms. An many times to invite Ms. An to hand over the decision to force quit her job and hand over the official file, but Ms. An did not cooperate. The school also sent someone. I can only say that because the People’s Committee of H. Mo Cay Bac is asking the school to submit a report, because Ms. An has reported this incident to the Secretary of the Provincial Party Committee”.
Meanwhile, Mr. Nguyen Thanh Hung, Head of Education and Training Department at H. Mo Cay Bac, said that according to the regulations of the Ministry of Home Affairs, the original records of officials are permanently stored at the management agency. When an employee resigns, he/she will be issued with a “Resume of the officer” and related decisions. The time Ms. An’s contract was terminated took effect on December 1, 2022. Regarding the decisions and documents that must be given to Ms. An when she was forced to quit her job, Thanh Tan School reported that it had been given to an biological sister of Ms. An. If Ms. An wants to receive the official records back, she can ask Thanh Tan Primary School to re-issue them because the original records are still stored at this school in the group of retired officials.
