Recently, the Ministry of Home Affairs has issued Circular 13/2022 guiding the determination of the rank structure of civil servants.
Specifically, this circular guides the determination of the rank structure of civil servants in agencies and administrative organizations of ministries, ministerial-level agencies, and agencies attached to the Government; organizations established by the Government or the Prime Minister but not as public non-business units; People’s Councils, People’s Committees of provinces and centrally run cities.
The Circular clearly stipulates that the determination of the civil servant rank structure of each agency, administrative organization of the ministries, branches and localities is based on a number of factors.
The first is the list of job positions for specialized professional civil servants and for professional civil servant positions shared jointly by the Ministry of Home Affairs and line and field management ministries in accordance with regulations on employment positions and civil servant payrolls.
The second is the complexity of the job and the number of civil servants that need to be arranged according to each job position in the agency or organization that has been approved by the competent authority. The third is the standard of titles and titles of specialized civil servants corresponding to the job position.
“When determining the rank structure of civil servants of administrative agencies and organizations, civil servants holding leadership and management positions are not counted” – Circular stated.
In addition, the Ministry of Home Affairs also specifies the order to determine the structure of civil servant ranks. Accordingly, the head of the agency employing civil servants shall base on the factors determining the rank structure, the list of employment positions and the number of civil servant payrolls arranged for each job position to determine the rate of employment. percentage of civil servants holding civil servant ranks according to each major in their agency or organization. At the same time, report to competent authorities for approval.
The head of the agency managing civil servants shall approve the civil servant rank structure in accordance with the complexity of the job according to the job position, nature, characteristics and scale of operation of the agency employing the civil servant.
The department in charge of personnel organization of the agency, organization or unit shall advise and assist the head in determining the number of civil servant ranks and the structure of civil servant ranks of the agency or organization. units to submit to competent authorities for consideration and decision.
This Circular takes effect from February 15, 2023.
